Be Part of the Solution: Don't Spread Misinformation

In recent weeks, the Carrara Nevada lobbying team has seen a series of emails targeting unsuspecting REALTORS® about the potential passage of two bills from the last legislative session: AB141 (no cause eviction notification timelines) and AB161 (summary eviction). Titled "More Government Rule," the email says that "the Nevada Legislature is proposing to make it even more difficult to get rid of naughty tenants."

In recent weeks, the Carrara Nevada lobbying team has seen a series of emails targeting unsuspecting REALTORS® about the potential passage of two bills from the last legislative session: AB141 (no cause eviction notification timelines) and AB161 (summary eviction). Titled "More Government Rule," the email says that "the Nevada Legislature is proposing to make it even more difficult to get rid of naughty tenants." The email goes on to say that members should contact their legislative representatives to tell them how "ridiculous" these bills are for the industry.

Let us put this to bed once and for all: if anyone has been paying attention, the lobbying team in Carson City - staff from Carrara Nevada and Nevada REALTORS® - successfully killed AB161 and substantially altered AB141 (no cause eviction is no longer addressed in the final version of the bill). The Legislature adjourned earlier this year, on May 31 specifically, and has not been back in session since sine die.

While a special session WILL OCCUR later this month, the team DOES NOT expect either of these bills to be reintroduced. On the off chance that they are on the table for the special session, the lobbying team for the REALTORS® will be in Carson City and on top of all things real estate related. Please rest assured that the email floating around in real estate circles is WILDLY OUTDATED, and could be used for fundraising efforts of some organization or as an attempt to continue to scare our members about action by the Legislature.

When you receive these types of emails, please check with your Government Affairs team at either the state or local associations first before passing them on to friends and family and creating unnecessary angst and concern within the REALTOR® community. The association employs paid professionals to keep an eye on action coming out of the Legislature and local governmental bodies. We will alert you in the event that we need member engagement and involvement - just like we did last spring when AB141 and AB161 were introduced. Until then, please continue to do what you do best - sell real estate and promote our great state!

Eviction Filing in Southern Nevada

Last year, in the throes of the pandemic, the court days were changed from five days a week to four in Clark County. Through an administrative order, Chief Justice Melissa Saragosa reinstituted the customer service division being opened on Fridays, making Friday a judicial day once again. SD16 Senatorial Appointment

Senate District 16 represents a portion of Washoe County and Carson City. Washoe County and Carson City met jointly on November 10, 2021, to select a replacement for the resigned Senator Ben Kieckhefer. As this appointment will represent counties during the redistricting process at a Special Session of the Nevada Legislature, the selection is of great importance to both bodies. The Washoe County Commissioners and Carson City Supervisors voted to appoint mortgage broker Donald Tatro to the open state Senate seat.

Washoe County Short-Term Rental (STR) Ordinance

At a Workshop on October 25, 2021, Washoe County staff discussed the short-term rental (STR) ordinance enacted in May 2021. At the time of this workshop, Washoe County had received between 500 and 600 applications. The majority of the applicants are located within the Lake Tahoe Basin. Washoe County staff indicated that many applications submitted contained omissions and other errors. Occupancy issues seem to have been the biggest stumbling block and, as such, Washoe County will be looking at a means to better define occupancy. It is anticipated that additional changes may be considered with the new language to go before the Washoe County Commission in early 2022.

Washoe County to Transfer Property at Cares Campus to Nevada Hopes

The Washoe County Board of Commissioners has approved a land transfer of land adjacent to the Nevada Cares Campus located on east 4th Street in Reno to Northern Nevada Hopes. The vacant parcel of land was previously owned by Truckee Meadows Water Authority (TMWA) which transferred ownership to Washoe County in August of 2021. The parcel is slated for a health clinic to be owned by Nevada Hopes to serve the Nevada Cares Campus. A public hearing will now be planned to hear any objections to the transfer before it is finalized. This is the continued expansion of the Nevada Cares Campus, which now includes the homeless shelter and a safe camping site which provides an approved tent and a campsite next to the Cares Campus.
