MLS Rules & Regulations Update
New Commencement Date & Submission Date Requirements
Release Date: April 20, 2026 at 3:36 PMPlease be advised that MLS Rules & Regulations have been recently updated regarding the “Commencement Date” and “Submission Date” of listings. A newly revised listing agreement will be live on Transaction Desk on April 30, 2026.
Key points of the revised rule (Section 4.0 – Listing Procedures):
- The Commencement Date is the date stated in the listing agreement on which the exclusive right to sell or exclusive agency relationship between the listing broker and the seller begins.
- The Submission Date is the date identified in the listing agreement by which the listing must be delivered to the MLS, subject to the maximum timeline allowed under the Rules.
- Listings must be delivered to the MLS no later than 11:59 p.m. PT on the Submission Date stated in the listing agreement, or within one (1) business day of marketing the property to the public, whichever is less.

The Listing Agreement Must:
- Contain all required signatures of Seller(s), Broker, and Agent.
- Clearly state both the Commencement Date and, if different, the Submission Date.
- The Submission Date must be no later than ten (10) calendar days after the Commencement Date.
- If the listing agreement does not specify a Submission Date, then the Submission Date is the same as the Commencement Date, and the listing must be submitted to the MLS by 11:59 p.m. PT on that date, unless earlier submission is required under Section 4.1 (Clear Cooperation) due to public marketing.
- The Submission Date may be set later than the Commencement Date only for legitimate preparation activities, such as: Staging, Repairs, Cleaning, Photography, Measurements, and other bona fide listing-related preparations.
- The Submission Date may not be used to delay MLS submission or circumvent MLS rules.
- No public marketing is permitted between the Commencement Date and the Submission Date.
- Violations of this rule may result in an automatic fine (excluding violations governed by Section 4.1 Clear Cooperation).
