Updated EPA Lead Disclosure Forms and Nevada Residential Disclosure Guide
Updated forms from the EPA and Nevada Real Estate Division are now available.

Please be advised that updated versions of the following forms have recently been released and are available for your immediate use. These forms have also been submitted for integration into Transaction Desk and Transact. We will notify members once they become available within those platforms.
The U.S. Environmental Protection Agency (EPA) has released the updated Protect Your Family from Lead in Your Home pamphlet and the Disclosure of Lead-Based Paint Lessor/Seller. These forms can also be downloaded directly from EPA website:

The Nevada Real Estate Division has also published the Ninth Edition of the Nevada Residential Disclosure Guide. It can also be downloaded directly from the Division’s website:

Key updates to the Residential Disclosure Guide include:Revisions to the Public Offering Statement section to reflect updated disclosure requirements, including association financial reporting obligations, purchaser cancellation rights, and additional disclosures for certain common-interest communities and condominium hotels.Updated references to the Waiver of Duty to Present All Offers and Authorization to Negotiate Directly with Seller to reflect the consolidated Waiver and Authorization to Negotiate Directly with the Client form.Addition of a Restrictive Covenant Modification disclosure section addressing the removal of discriminatory property restrictions, including petition procedures, court order requirements, recording requirements, and related provisions under NRS 111.237.Expanded Environmental Hazards guidance recommending well testing by a laboratory certified by the State of Nevada Environmental Commission and emphasizing buyer due diligence regarding potential environmental hazards.
Pursuant to NRS 645.194, licensees are required to provide the Nevada Residential Disclosure Guide to prospective buyers and sellers in residential real estate transactions.
